DEFINITIONS

    1. Personal Data Administrator, Administrator - Mary Bratko entrepreneur conducting business under the name Mary Bratko in Tomaszow Lubelski, Tomasza Zamojskiego Street, No. 41/8, 22-600 Tomaszow Lubelski, NIP: 7123439903;

    2. Personal data - all information about a natural person identified or identifiable by one or more specific factors that determine physical, physiological, genetic, mental, economic, cultural or social identity, including device IP, location data, Internet ID and information collected through cookies and other similar technology.

    3. Policy - this Privacy Policy.

    4. RODO - Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

    6. User - any natural person visiting the Site or using one or more of the services or functionalities described in the Policy.

  1. PROCESSING OF DATA IN CONNECTION WITH THE USE OF THE WEBSITE

    1. In connection with the User's use of the Site, the Administrator collects data to the extent necessary to provide the services offered, as well as information about the User's activity on the Site. Detailed rules and purposes of processing personal data collected during the User's use of the Site are described below.

  2. PURPOSES AND LEGAL BASIS OF DATA PROCESSING

    1. ENJOYMENT OF THE SITE

      1. Personal data of all persons using the Site (including IP address or other identifiers and information collected through cookies or other similar technologies), and who are not registered Users (i.e. persons who do not have an account profile on the Site) are processed by the Administrator:

        1. in order to provide services electronically in terms of providing Users with access to content collected on the Site, providing contact forms - then the legal basis for processing is the necessity of processing for the performance of the contract (Article 6(1)(b) RODO);

        2. for the purpose of handling complaints - in which case the legal basis for processing is the necessity of processing for the performance of the contract (Article 6(1)(b) of the DPA);

        3. for analytical and statistical purposes, in which case the legal basis for the processing is the legitimate interest of the Administrator (Article 6(1)(f) of the RODO), consisting of conducting analyses of Users' activities, as well as their preferences in order to improve the functionalities used and services provided;

        4. for the purpose of possible establishment and investigation of claims or defense against them - the legal basis of the processing is the legitimate interest of the Administrator (Article 6(1)(f) of the DPA) to protect your rights;

    2. TRAINING REGISTRATION

      1. People who register on the Site for training courses and workshops conducted by the Administrator are not required to register on the Site and create an account on the Site. In order to register a visit, the User must go through the registration procedure, i.e. select the details of the training, provide his/her personal data, i.e. first name, last name, e-mail address. Providing data marked as mandatory (i.e. first name, last name and telephone number) is required for registration for training courses and workshops. 

      2. Personal data are processed:

        1. for the purpose of providing services related to registration for trainings and workshops conducted by the Administrator - the legal basis for processing is the necessity of processing for the performance of the contract (Article 6(1)(b) RODO), and with regard to data provided optionally - the legal basis for processing is consent (Article 6(1)(a) RODO);

        2. for analytical and statistical purposes - the legal basis for the processing is the legitimate interest of the Administrator (Article 6(1)(f) of the RODO), consisting of conducting analyses of Users' activity on the Site and the way they use their account, as well as their preferences in order to improve the functionalities used;

        3. for the purpose of possible establishment and investigation of claims or defense against them - the legal basis for processing is the legitimate interest of the Administrator (Article 6(1)(f) of the DPA) to protect your rights.

        4. for the Administrator's marketing purposes - the principles of processing personal data for marketing purposes are described in the section under the heading MARKETING. 

        5. If you post any personal information of others (including their name, address, telephone number or e-mail address) on the Site, you may do so only under the condition that you do not violate the provisions of applicable law and the personal rights of such persons, and with their consent.

    3. CONTACT

      1. The Administrator shall provide the opportunity to contact him using e-mail or telephone contact. The Administrator also provides the possibility to contact him using electronic contact forms. Using the form requires providing personal data necessary to contact the User and respond to the inquiry. The User may also provide other data to facilitate contact or handling of the inquiry. Provision of data marked as mandatory is required in order to accept and service the inquiry, and failure to provide such data will result in the impossibility of service. Provision of other data is voluntary

      2. The personal data of the User who contacts the Administrator by means of an e-mail address or telephone or by means of a contact form are processed:

        1. in order to identify the sender and handle his/her inquiry sent through the form provided - the legal basis for processing is the necessity of processing to perform the service contract (Article 6(1)(b) RODO); 

        2. for analytical and statistical purposes - the legal basis for processing is the legitimate interest of the Administrator (Article 6(1)(f) of the RODO), consisting of keeping statistics on queries submitted by Users via the Site in order to improve its functionality.

  3. MARKETING

    1. MARKETING OBJECTIVES

      1. The Administrator processes Users' personal data in order to carry out marketing activities, which may consist of:

        1. displaying marketing content to the User that corresponds to the User's interests (behavioral advertising);

        2. targeting e-mail notifications of interesting offers or content, which in some cases contain commercial information;

      2. In order to carry out marketing activities, the Administrator uses profiling in some cases. This means that through automated data processing, the Administrator evaluates selected factors about individuals in order to analyze their behavior or create a forecast for the future.

    2. BEHAVIORAL ADVERTISING

      1. The Administrator processes Users' personal data, including personal data collected through cookies and other similar technologies, for marketing purposes in connection with targeting Users with behavioral advertising (i.e. advertising that is tailored to Users' preferences). Processing of personal data then includes profiling of Users. The use of personal data collected through this technology for marketing purposes takes place on the basis of the Administrator's legitimate interest and only on the condition that the User has consented to the use of cookies. Consent to the use of cookies can be given through the appropriate configuration of the browser, and can be withdrawn at any time, in particular by clearing the history of cookies and disabling cookies in the browser settings.

      2. This consent can be withdrawn at any time.

    3. DIRECT MARKETING

      1. If the User has consented to receive marketing information via e-mail, the User's personal data will be processed for the purpose of sending such information. The basis for data processing is the legitimate interest of the Administrator to send marketing information within the limits of the consent given by the User (direct marketing). The User has the right to object to the processing of data for direct marketing purposes, including profiling. The data will be kept for this purpose for the duration of the Administrator's legitimate interest, unless the User objects to receiving marketing information.

  4. SOCIAL MEDIA

    1. The Administrator processes personal data of Users visiting the Administrator's profiles maintained on social media (Facebookm Instagram or Youtube). The data is processed exclusively in connection with the running of the profile, including for the purpose of informing Users about the Administrator's activities and promoting various events, services and products, as well as for the purpose of communicating with users through the functionalities available on social media. The legal basis for the Administrator's processing of personal data for this purpose is its legitimate interest (Article 6(1)(f) RODO) in promoting its own brand and building and maintaining a brand-related community.

    2. The Site shows integrated social media plug-ins. This means that if the User clicks on one of such buttons (such as "Like" on Facebook) certain information will be shared with the providers of these social channels. If the User is logged in at the same time on the given account social networks, the social service provider may link this information to the User's account on the social channel and make the activities on the User's profile public in such a way that they are shared with other network users.

    3. Plug-ins so-called plug-ins of social networks, including Facebook.com and Youtube and others, may be located on the Site. The related services are provided by Facebook Inc. and Google respectively.

    4. The plug-in only provides its provider with information about the time the User accessed the Site. If, while viewing the Site or staying on the Site, the User is logged into his or her account located on, for example, Facebook or Instagram, the provider is able to combine the User's interests, information preferences, and other data, obtained, for example, by clicking the "Like" button or leaving a comment, or entering the profile name in searches. Such information will also be transmitted by the browser directly to the provider. In order to avoid a visit to the selected User's account being recorded by Facebook Instagram on the Website, you must log out of your account before browsing the Website.

    5. The Site also contains links to websites administered by entities independent of the Administrator, i.e. Facebook and You Tube. Separate privacy clauses or policies may apply there. The Administrator encourages you to familiarize yourself with their content, as the Administrator has no control over the data collected and data processing processes, as well as no knowledge of the full extent of their acquisition, the purpose of their processing or the duration of their storage. The Administrator also has no information on the deletion of data collected by plug-in providers.

    6. The Site publishes videos that are uploaded to YouTube. For all of these videos, an "enhanced data protection mode" is used, which means that no data about you as a user is transferred to YouTube if you do not play the videos. It is only when the video is played that personal data is transferred. We have no control over this type of data transfer. 

    7. When you visit the Site and play a particular video posted on YouTube, YouTube is informed that you have opened the video on the Site, which involves the transfer of personal information to YouTube. This is done regardless of whether YouTube provides a User account through which you are logged in or whether there is no User account. If you are logged into Google (and therefore YouTube), your data is assigned directly to your account. If you do not wish to be assigned to a YouTube profile, you must log out before playing the video. YouTube saves your data as user profiles and uses them for advertising, market research and to shape its website according to demand. Such analysis is carried out primarily (also for non-logged-in users) in order to present demand-driven advertising, as well as to inform other users of the social network about your activity on our website. You have the right to object to the creation of such user profiles, but you should contact YouTube to exercise this right.

    9. The Site also features an integrated communicator for contacting the Administrator, based on a messenger based on solutions belonging to WIX.

  5. COOKIES AND SIMILAR TECHNOLOGY

    1. Cookies are small text files installed on the device of the User browsing the Website Cookies collect information to facilitate the use of the Website - for example, by remembering the User's visits to the Website and the activities he/she performs.

      1. "SERVICE" COOKIES

        1. The Administrator uses so-called service cookies primarily to provide the User with services provided electronically and to improve the quality of such services. In this regard, the Administrator and other entities providing analytical and statistical services to the Administrator use cookies to store information or access information already stored in the User's telecommunications end device (computer, phone, tablet, etc.). Cookies used for this purpose include:

          1. cookies with data entered by the User (session ID) for the duration of the session (user input cookies);

          2. authentication cookies used for services that require authentication for the duration of the session (authentication cookies);

          3. Security cookies, such as those used to detect authentication abuse (user centric security cookies);

          4. multimedia player session cookies (e.g. flash player cookies), for the duration of the session (multimedia player session cookies);

          5. Persistent cookies used to personalize the user interface for the duration of the session or slightly longer (user interface customization cookies),

          6. cookies used to remember the contents of your shopping cart for the duration of your session (shopping cart cookies);

        2. To collect statistics, the Administrator uses the Google Analytics product, thus the data of the User visiting the Website will be received by Google, 1600 Amphitheatre Parkway Mountain View, CA 94043 United States. Google is certified in the Privacy Shield program. As part of the agreement between the United States and the European Commission, the latter has stated an adequate level of data protection for companies certified by Privacy Shield.       2. "MARKETING" COOKIES

        1. The Administrator also uses cookies for marketing purposes, including in connection with targeting Users with behavioral advertising. For this purpose, the Administrator stores information or accesses information already stored in the User's telecommunications terminal device (computer, phone, tablet, etc.). The use of cookies and personal data collected through them for marketing purposes requires the User's consent. This consent can be given through the appropriate configuration of the browser, and can be withdrawn at any time, in particular by clearing the history of cookies and disabling cookies in the browser settings.

      3. GOOGLE ADS, FACEBOOK PIXEL

        1. The site uses the Google Ads program. 

        2. Google Ads is a program of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ("Google"). As part of Google Ads, the Administrator uses so-called conversion tracking. When you click on an advertisement displayed by Google, a conversion tracking cookie is generated. Cookies (cookies) are small text files stored in the browser on the user's computer. Such cookies expire after 30 days and are not used to identify the user personally. If a user accesses certain pages of this website and the cookie has not yet expired, Google and the Site are informed that the user was redirected to that page after clicking on an advertisement.

        3. Each Google Ads customer receives a different cookie. Cookies cannot be tracked by Ads customer websites. The information collected through the conversion cookie is used to compile conversion statistics for Ads customers who have opted in to conversion tracking. Customers receive information about the total number of users who clicked on an ad and were redirected to a page provided with a conversion tracking tag. However, they do not receive information from which the user's persona can be identified. If you do not wish to participate in conversion tracking, you can object to the use of this feature. In order to conduct effective marketing campaigns and promotions of the Goods sold by the Administrator through the Online Store, the Administrator uses the "Facebook Pixel" option, which is provided by the Facebook social network operated by Facebook Inc., 1601 S. California Ave., Palo Alto, CA 94304, USA or, for users who are EU residents, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"). The Facebook Pixel is a piece of code placed on the website of the Online Store. It allows Facebook to identify visitors to the Administrator's web content as a target group for displaying Facebook advertisements on their social profiles (e.g. as part of sponsored advertising), which we understand to be our legitimate interest (Article 6(1)(f) RODO). Thus, as part of the Facebook Pixel function, it is possible to display the Administrator's published advertisements on Facebook only to Facebook users who have shown interest in our services or who have certain common coefficients (such as interests in certain topics or products determined on the basis of visited tabs on our website, viewed products) that we provide to Facebook (this is due to the operation of the Pixel installed on our website). The Facebook Pixel function also helps the Administrator understand the effectiveness of Facebook ads for statistical and market research purposes, showing whether users were redirected to our services after clicking on a Facebook ad (so-called conversion, allowing us to determine on which devices a user performs an action), in order to create so-called similar audiences or statistical twins (i.e., broadcasting ads to target groups similar to existing customers), and to obtain comprehensive statistics on site usage. During a user's visit to our site, the Facebook Pixel function establishes a direct connection to Facebook servers. In this way, the Facebook server is notified that you have visited our site, and Facebook assigns this information to your personal Facebook user account.

  6. PERIOD OF PROCESSING OF PERSONAL DATA

    1. We will process personal data for the duration of the contract and for the time necessary to demonstrate performance of the contract, i.e. the length of the statute of limitations for claims.

  7. USER RIGHTS

    1. Data subjects have the following rights:

      1. The right to information about the processing of personal data - the Administrator provides information about the processing of personal data, including, in particular, the purposes and legal grounds for processing, the scope of the data held, the entities to which the personal data are disclosed and the planned date for their deletion; 

      2. The right to obtain a copy of the data - the Administrator provides a copy of the processed data, concerning the person making the request;

      3. Right of rectification - The Administrator shall remove any inconsistencies or errors regarding the processed personal data, and complete or update them if they are incomplete or have changed;

      4. The right to erasure (the so-called right to forget) - is the basis for requesting the deletion of data, the processing of which is no longer necessary to carry out any of the purposes for which they were collected;

      5. The right to restrict processing - the Administrator shall cease performing operations on personal data, except for operations consented to by the data subject and their storage, in accordance with established retention rules, or until the reasons for restricting processing cease to exist (e.g., a decision of a supervisory authority authorizing further processing is issued);

      6. Right to data portability - to the extent that the data are processed in connection with a concluded contract or consent, the Administrator shall issue the data provided by the data subject in a computer-readable format. It is also possible to request that the data be sent to another entity - provided that both the Administrator and the other entity to which the data is sent have the appropriate technical conditions for such transmission;

      7.  Right to object to processing for marketing purposes - the data subject may object at any time to the processing of personal data for marketing purposes, without having to justify such objection;

      8. Right to object to other purposes of processing - the data subject may object at any time to the processing of personal data on the basis of a legitimate interest of the Controller (e.g. for analytical or statistical purposes or for reasons related to property protection). An objection in this regard should contain a justification and is subject to review by the Controller;

      9. Right to withdraw consent - if the data are processed on the basis of consent, the data subject has the right to withdraw it at any time, which, however, does not affect the lawfulness of processing carried out prior to the withdrawal of such consent;

      10. The right to complain - if the processing of personal data is deemed to violate the provisions of the RODO or other data protection laws, the data subject may file a complaint with the President of the Office for Personal Data Protection.

    5. If the Administrator is unable to determine the content of the request or identify the requester based on the notification made, it will ask the requester for additional information.

    6. Applications will be responded to within one month of receipt. If it is necessary to extend this period, the Administrator will inform the applicant of the reasons for such extension.

The response will be provided to the e-mail address from which the application was sent, and in the case of applications sent by letter, by regular mail to the address indicated by the applicant, unless the content of the letter indicates a desire to receive feedback to the e-mail address (in which case the e-mail address must be provided).

  8. DATA RECIPIENTS

    1. In connection with the performance of services, personal data will be disclosed to external entities, including, in particular, suppliers responsible for the operation of IT systems, entities such as payment operators, entities providing accounting, legal, auditing, or consulting services.

    2.  The Administrator reserves the right to disclose selected information concerning the User to competent authorities or third parties who make a request for such information, relying on the relevant legal basis and in accordance with the provisions of the applicable law.

  9. TRANSFER OF DATA OUTSIDE THE EOG

    1. The Administrator of personal data will not transfer personal data of the Site Users to a third country (outside the European Economic Area) or an international organization, except in situations and entities expressly indicated in this privacy policy (such as: Google, Facebook). 

  10. SECURITY OF PERSONAL DATA

    1. The Administrator conducts a risk analysis on an ongoing basis to ensure that personal data is processed by the Administrator in a secure manner - ensuring, first and foremost, that only authorized persons have access to the data and only to the extent necessary due to the tasks they perform. The administrator ensures that all operations on personal data are recorded and performed only by authorized employees

      and associates.

    2. The Administrator shall take all necessary measures to ensure that its subcontractors and other cooperating entities also provide guarantees to apply appropriate security measures whenever they process personal data on behalf of the Administrator.

  12. COMPLAINTS RELATED TO THE PROVISION OF ELECTRONIC SERVICES

    1. The Administrator shall take measures to ensure fully correct operation of the Site, to the extent of current technical knowledge, and undertakes to remove

      within a reasonable period of time any irregularities reported by Users.

    2. The User shall immediately notify the Administrator of any irregularities or interruptions in the functioning of the Site.

    3. Irregularities related to the functioning of the Site may be reported by the User in one of the ways of his choice:
